Right of Withdrawal

Scope

The statutory right of withdrawal described below applies only where required by applicable consumer protection law.

Where no statutory right of withdrawal exists under the applicable mandatory consumer protection law, returns from countries outside the European Union are accepted only under our voluntary return policy and require our prior written approval.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, takes possession of:

  • the goods, if the contract concerns a single item;
  • the last item, if you ordered several goods delivered separately;
  • the last partial shipment or piece, if the goods are delivered in several partial shipments or pieces;
  • the first delivery, if the contract concerns regular delivery of goods over a defined period.

To exercise your right of withdrawal, contact us:

Bilker Allee 16
40219 Düsseldorf, Germany
E-mail: shop@jimgreenfootwear.eu
Tel.: +49 211 924 198 65

By a clear statement (e.g., by post or e-mail). You may use the attached model withdrawal form, but this is not required.

Consequences of Withdrawal

  • If you withdraw from this contract, we will refund all payments received, including standard delivery costs (except additional costs for choosing a different delivery method), without undue delay and no later than fourteen days after we receive your notice of withdrawal.
  • We will use the same payment method used in the original transaction. No fees will be charged for the refund.
  • We may withhold the refund until we have received the goods back or you have provided proof of return, whichever is earlier.

Return of Goods

Return the goods to:

Jim Green Footwear Europe

E-mail: shop@jimgreenfootwear.eu

Return Shipping Costs

  • Voluntary withdrawal: You bear the direct costs of returning the goods.
  • Defective goods / wrong delivery: Do not return the goods on your own. We will provide a prepaid DHL return label. Return is free of charge. Reimbursement of shipping costs only applies if a label is provided by us.

Liability for Diminished Value

You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. Shoes must not be worn outside; sensitive leather (e.g., oily pull-up leather) may crease quickly and is considered used if visibly affected.

Hygiene / Sealed Goods

The right of withdrawal does not apply to goods that cannot be returned for health or hygiene reasons once opened, if delivered sealed and the seal has been removed.

Shoe Try-On Guidelines

Please try on shoes only indoors on a clean surface (e.g. carpet) and only for the time necessary to check fit and size.

Sensitive leathers – especially oily pull-up, pull-up, full-grain and untreated natural leather – develop visible creases very quickly when walking. Such creases qualify as signs of use and may result in a reduction of the refund amount in accordance with §357 (7) BGB.

Visible walking creases, sole wear or stronger signs of use may lead to a proportional deduction based on the loss in value.

Returns from Non-EU Countries

Returns from countries outside the European Union require our prior written authorization.

The sender is responsible for:

  • completing all customs declarations correctly,
  • providing all required customs documentation,
  • accurately describing the contents,
  • attaching a copy of the original invoice to the outside of the parcel.

The sender remains responsible for ensuring that all customs information and declarations are accurate and complete, irrespective of whether they are completed electronically or with the assistance of a postal operator. Incomplete or incorrect customs documentation may result in delays, storage charges, customs duties, handling fees or refusal of the shipment.

Any customs duties, taxes, storage charges, handling fees or other documented costs arising from incorrect or incomplete customs documentation remain the sender’s responsibility and, where permitted by applicable law, may be set off against any refund.

Any return shipment from outside the European Union sent without our prior written authorization may be refused or returned to the sender at the sender’s expense.

Where permitted by applicable law, we reserve the right to set off any customs duties, taxes, storage charges, handling fees or other documented costs arising from incorrect or incomplete customs documentation against any refund.
